Terms of donation service

Charitable Organization “International Charitable Foundation “Ocean of Hope”, chaired by Ostap Holinka, acting on the basis of the Statute, hereinafter referred to as the Beneficiary, invites legal or natural persons, hereinafter referred to as the Benefactor, to enter into a Voluntary Donation Agreement under the following conditions.

This proposal is a public offer in accordance with Article 633 of the Civil Code of Ukraine. Acceptance of this offer is the implementation of the Benefactor’s transfer of funds to the current account of the Beneficiary. Acceptance of this offer by the Benefactor means that the latter has read and agrees to all the terms of this Voluntary Donation Agreement with the Beneficiary.

1. Scope of the contract

• Under this agreement, the Benefactor as a voluntary donation transfers its own funds to the current account of the Beneficiary, and the Beneficiary accepts the donation and uses it in accordance with the purpose specified in the Statute.

2. Concluding a contract

• The moment of concluding the agreement and its entry into force is considered to be the moment of receipt on the Beneficiary’s account of the funds transferred by the Benefactor as a donation. This agreement is valid until the parties fully fulfill their obligations and may be renewed an unlimited number of times by the next transfer of voluntary donations by the Benefactor.

3. Rights and duties

• The organization undertakes to use the funds received from the Benefactor under this Agreement in strict accordance with the current legislation of Ukraine and within its statutory activities.
• The benefactor has the right to choose the purpose of the donation at his own discretion, indicating the appropriate “purpose of payment” during the transfer of the donation. The current list of donation goals is published on the website https://oceanofhopeukraine.org/, in social networks and mass media.
• When receiving a donation without specifying the purpose, the Organization independently specifies its use, based on the budget items of the Charitable Program of the Organization.
• When receiving a donation indicating the purpose, such as the name and surname of the needy, or when receiving a donation to a specific ward selected by the benefactor on the website https://oceanofhopeukraine.org/, the Organization uses the donation to help this person. If the amount of donations to a particular person exceeds the amount needed to provide assistance, the Organization informs the Benefactors. The Organization uses the positive difference between the amount of donations received and the amount needed to provide assistance to a particular person to implement the Organization’s Charitable Program, while maintaining priority in the use of balances to help others in need. By making a donation, the Benefactor agrees that after fulfilling the purpose specified in the donation, the Organization independently determines the purpose of using the donation within the Charitable Program of the Organization.
• Donations received by the Organization without specifying a specific purpose are sent to the implementation of the Charitable Program of the Organization.
• By making a donation, the Benefactor agrees that in accordance with the Law of Ukraine “On Charitable Activities and Charitable Organizations” the Organization has the right to use part of the proceeds to finance administrative costs. The maximum amount of funds used for administrative expenses of the Organization may not exceed 20 (twenty) percent of the amount of income in the current year.
• The Benefactor agrees to the Organization to process the personal data provided by the Benefactor during the voluntary donation (name, address, place of residence, e-mail address, and bank details for the purpose of this agreement).
• The Benefactor agrees that the amount of the donation is non-refundable.
• The Beneficiary shall not have any obligations to the Benefactor other than those specified in this Agreement.
• The organization provides assistance in accordance with approved charitable programs and projects.
• The Organization undertakes to send to the Benefactor, to the e-mail address indicated on the website https://oceanofhopeukraine.org/, information about the funds raised regarding the wards of the Organization.
• The activities of the Organization are not for profit.
• The organization publishes information about its work and reports on the results of activities at https://oceanofhopeukraine.org/.

4. The amount of the donation

• The Benefactor independently determines the amount of the voluntary donation and transfers it to the Beneficiary’s current account under the terms of this Agreement, or through the acquiring system, if the transfer is made by the benefactor on the site.

5. Making a donation

• The philanthropist independently determines the amount of the voluntary donation and makes it in any convenient way specified on the website https://oceanofhopeukraine.org/ under the terms of this Agreement.
• The fact of transferring the donation to the account of the Organization, within the framework of the Organization’s projects, testifies to the full consent of the Benefactor to the terms of this Agreement.
• If the method of transfer of the donation chosen by the Benefactor does not allow to indicate the “purpose of payment”, the Benefactor has the right to specify the purpose of the donation in another written way.
• In case of transfer of the donation for correct identification of the payer, the Philanthropist indicates his contacts: e-mail address and / or telephone number.
• The date of acceptance of the Offer and, accordingly, the date of conclusion of the Agreement is the date of receipt of the Benefactor’s funds on the current account of the Organization.

6. Miscellaneous

• In the event of disputes and disagreements between the Parties under this Agreement, they may, if possible, be resolved through negotiations. In case of impossibility to resolve the dispute through negotiations, disputes, and disagreements may be resolved in accordance with the current legislation of Ukraine in court at the location of the Beneficiary.
• The text of this Agreement, forms of bank payment orders, as well as in case of withdrawal of this Offer notice thereof, are published on the official website of the Beneficiary https://oceanofhopeukraine.org/.
